Terms of service

Version 1.0 · September 2026. A signed service agreement between MedSaakshi and each hospital takes precedence over these terms. This page will be reviewed by counsel before commercial launch.

1. The service

MedSaakshi is a record-keeping tool. It captures what a hospital's staff enter and what patients and relatives sign and say. It does not give medical advice, does not decide whether a consent is legally sufficient, and does not replace the clinical judgement or the legal obligations of the treating doctor and the hospital.

2. Accounts

Each person uses their own login. Sharing a login or a PIN is a breach of these terms, because the value of every record depends on knowing who made it. The hospital administrator is responsible for adding and removing staff promptly.

3. Your data

Records created by a hospital belong to the hospital. Records created in a doctor's own practice space belong to that doctor. MedSaakshi processes them only to provide the service, as described in the privacy policy. You may export all your data at any time.

4. Availability and backups

We aim for the service to be available at all times and keep off-site backups every six hours, but no online service is available 100% of the time. Records saved on a device while the network is down upload automatically when it returns. We are not liable for records that were never saved because a device was lost or damaged before upload.

5. Retention and termination

Records are kept for at least the retention period agreed with the hospital, and never deleted because a subscription lapsed. On termination you receive a complete export. If MedSaakshi ceases operation, you receive at least 90 days' notice and a full export.

6. Acceptable use

The service may be used only for genuine clinical consent and communication records. Recording a person without informing them, entering false records, or attempting to access another organisation's data is prohibited and will result in termination.

7. Fees

Fees, if any, are as agreed in writing with the hospital or doctor. A free tier may be offered with limits stated in the app.

8. Liability

To the extent permitted by law, MedSaakshi's total liability for any claim arising from the service is limited to the fees paid by the customer in the 12 months before the claim. MedSaakshi is not liable for clinical outcomes, or for the legal sufficiency of any consent recorded through the service.

9. Governing law

These terms are governed by the laws of India. Courts at Tirupati, Andhra Pradesh have jurisdiction.
